Decree of the President of the Republic of Uzbekistan  "On the Red Crescent Society of Uzbekistan"

OF THE REPUBLIC OF UZBEKISTAN
ON THE USE AND PROTECTION OF EMBLEMS OF
RED CROSS AND RED CRESCENT

 

Article 1. Purpose of this Law

The purpose of this Law is to regulate the use and protection of the red crescent and red cross emblems, distinctive signals, and names "Red Crescent" and "Red Cross".

 

Article 2. Legislation on the use and protection of the red crescent and red cross emblems

Legislation on the use and protection of the red crescent and red cross emblems includes the present Law and other legislative acts.

If international treaty of the Republic of Uzbekistan stipulates other rules than those provided by the legislation of the Republic of Uzbekistan on the use and protection of the red crescent and red cross emblems, the rules of international treaty shall prevail.

 

Article 3. Basic Terms

The present Law includes the following basic terms:

medical vehicles - denote means of transport designed to transport wounded, ill persons, those who suffered shipwreck, as well as medical personnel and medical property;  

medical units - used to denote stationary and movable medical establishments (sub-divisions) and other civil and military medical units created to search, transport, diagnose or treat wounded and ill persons as well as those suffered shipwreck, including rendering them first aid, as well as to prevent deceases;

medical personnel - denotes persons appointed either on permanent or temporary basis to search, transport, diagnose or treat wounded and ill persons as well as those suffered shipwreck, including rendering them first aid, to prevent deceases and to provide material and other support to medical units;

distinctive signals - denote wireless signal, light signal, electronic identification or other signal that are used to identify medical units and sanitary and transport means.

 

 Article 4. Emblems of red crescent and red cross

An emblem of red crescent is an image of half-moon of red color on white background in the phase of crescent, recognized by international norms.

An emblem of red cross is an image of cross of red color on white background which four ends have the same length, recognized by international norms.

 

Article 5. Basic principles of use of emblems of red crescent and red cross

Emblems of red crescent and red cross are used for humane purposes exclusively.

Emblems of red crescent and red cross are equivalent upon their use.

 

Article 6. An emblem used by the Republic of Uzbekistan

The Republic of Uzbekistan uses emblems of red crescent.

Emblem of red crescent used by the Republic of Uzbekistan is an image of half-moon of red color on white background in phase of crescent which sharp ends are to the left of someone who looks at it. 

  

Article 7. Use of an emblem of red crescent

An emblem of red crescent may be used both as a distinctive emblem and protective one.

The red crescent emblem is used as a distinctive emblem to identify that certain buildings, constructions, vehicles and other property, and personnel belong to organizations of International Red Cross and Red Crescent Movement. In accordance with generally recognized international norms the distinctive emblem shall have a comparatively small size and it can not be used on armbands and placed on the roofs of buildings.

The red crescent emblem is used as a protective emblem to denote medical units, medical personnel and medical vehicles that assist to wounded and ill persons, those suffered in shipwreck and armed conflicts. Protective emblem shall be applied to a flat surface or flag and should be visible from all directions and from far away.

 

Article 8. The use of the red crescent emblem by military medical units

The military medical units shall use the red crescent emblem as a protective emblem to identify their medical personnel and medical vehicles.

Military medical personnel using the red crescent emblem as a protective emblem shall wear an armband with the red crescent emblem and have the identity card issued in the manner prescribed by law.

 

Article 9. Use of the red crescent emblem by civilian medical units

If there is the consent of the Red Crescent Society if Uzbekistan, civilian medical units providing free medical care may use in peacetime the red crescent emblem as a distinctive emblem to identify medical vehicles and the location of first aid stations.

In case of armed conflicts civilian medical units, medical personnel and medical vehicles shall be identified with red crescent emblem as a protective emblem only with the permission of the Ministry of Defense of the Republic of Uzbekistan. Medical personnel shall wear an armband with the red crescent emblem and have the identity card issued in the manner prescribed by law.

 

Article 10. Use of the red crescent emblem by the Red Crescent Society of Uzbekistan

Red Crescent Society of Uzbekistan uses the red crescent emblem as a distinctive emblem to identify the ownership of its buildings, structures, vehicles and other property, and personnel.

If the Red Crescent Society of Uzbekistan provides its medical units, medical personnel and medical vehicles for the period of armed conflicts to military medical units, the red crescent emblem shall be used as a protective emblem. Medical personnel in this period shall observe martial laws and shall wear an armband with the red crescent emblem and have the identity card issued in the manner prescribed by law.

 

Article 11. Use of the red crescent, red cross emblems by Red Crescent or the Red Cross Societies of foreign countries

Red Crescent and Red Cross Societies of foreign countries represented in the established order in the Republic of Uzbekistan shall use the red crescent or red cross emblems as a distinctive emblem under the control of the Red Crescent Society of Uzbekistan.

In the case of armed conflict by authority of the Ministry of Defense of the Republic of Uzbekistan and in hand of the Red Crescent Society of Uzbekistan, it is permitted to provide medical units, medical personnel and medical vehicles of the Red Crescent or Red Cross of third or other foreign countries, which do not participate in an armed conflict, to the disposal of military medical units to provide humanitarian assistance and use the red crescent or red cross emblem as a protective emblem. Medical personnel in this period shall observe martial laws and shall wear an armband with the red crescent emblem and have the identity card issued in the manner prescribed by law.

 

Article 12. Use of the red crescent, red cross emblems by organizations of the International Red Cross and Red Crescent Movement

The International Committee of the Red Cross and the International Federation of Red Cross and Red Crescent Societies shall use the red crescent or red cross emblem when performing their activities within the territory of the Republic of Uzbekistan.

 

Article 13. Protection of the red crescent and red cross emblems

The red crescent and red cross emblems are protected by the state.

Distinctive signals and names "Red Crescent" and "Red Cross", which are used in the manner prescribed by law, are protected by the state as well.

 

Article 14. Misuse of the red crescent and red cross emblems, distinctive signals, names "Red Crescent" and "Red Cross"

The red crescent and red cross emblems, distinctive signals, names "Red Crescent" and "Red Cross" or marks and names representing their imitation shall not be used in a commercial activity, and their treacherous use in armed conflicts is prohibited.

 

Article 15. Disputes settlement

Any disputes relating to the use and protection of the red crescent and red cross emblems shall be settled in the manner prescribed by law.

 

Article 16. Responsibility for violation of the law on use and protection of the red crescent and red cross emblems

Persons found guilty of violating the law on use and protection of the red crescent and red cross emblems shall be liable in due course.
